What is a Tourist Guide? When am I likely to be considered as a Tourist Guide?

Tour guiding is a licensed profession in Bali and in Indonesia more generally. Under the Regional Regulation of Bali No. 5 of 2016 on Tourist Guides ("Bali Regulation No. 5"), a Tourist Guide is defined as an Indonesian national having a duty to provide assistance, guidance and advice regarding tourism and all matters needed by tourists.

As the definition of a tourist guide and its scope of responsibility (see below) could be broadly interpreted, we encourage you to check with the tourism boards (dinas pariwisata) of the relevant regency offices or to speak to your lawyer to make sure you are following the laws.

Here are some examples of when you are likely to be considered to be acting as a Tourist Guide in Bali:

  • You bring a guest around Bali to visit the various museums and galleries while providing commentary about the places along the way.
  • The guest signs up for a paid Experience, you meet her in Ubud and bring her to various temples and eating places while providing information and commentary about the place.
  • You take a paying guest on a tour through the Sangeh Monkey Forest during which you provide detailed explanation of the fauna there.

Here are some examples of when you are unlikely to be considered to be acting as a Tourist Guide:

  • You love music and football, so you occasionally take guests to a local music gig, then to a stadium to watch a game.
  • You occasionally walk a guest through the neighbourhood where you were born and raised, you meet your local friends and then you have a meal together in your favourite local restaurant. You focus on showing people what it’s like to live in your area and introducing the guest to great locals.
  • You occasionally take someone to yoga and fitness classes, and then you run together by the river or around an interesting part of the city centre.

If I am considered to be a Tourist Guide, do I need to get a licence?

Yes.

Licence

Based on Bali Regulation No. 5, a Tourist Guide should obtain a Kartu Tanda Pengenal Pramuwisata / Tour Guide Identity Card ("KTPP"). There are two kinds of KTPP issued, namely a general KTPP for general tour guides and a specific KTPP for specific tour guides. Please note that foreigners are not eligible to apply for a KTPP under Bali Regulation No. 5.

A general Tourist Guide is a Tourist Guide whose work area is in more than one regency or city in Bali, while a specific Tourist Guide is a Tourist Guide who provides tour guiding activities that require competency certificates (please see below). For further information on the procedure for securing KTPP, we encourage you to check with the tourism boards of each regency office where you are offering your Experience.

Competency Certificate

According to the Minister of Tourism Regulation No. 19 of 2016 on the Mandatory Competency Certifications on Tourism, a Tourist Guide must also obtain competency certificates that are issued by the relevant Professional Certification Agency (Lembaga Sertifikasi Profesi or "LSP"). For example, a competency certificate is required if you are assisting with any outdoor or team building activities, water sports or diving activities, providing agriculture or ecotourism related Experiences, or any activity involving rock climbing, cave, mountain, agriculture, zoo and museum tourings. You can also find a list of LSPs in Bali on the official page of Profession Certification National Board (Badan Nasional Sertifikasi Profesi) as follows. We encourage you to reach out to the relevant LSP if you are not sure whether you need a competency certificate to offer your Experiences.

You may be subject to a fine and/or imprisonment if you operate as a Tourist Guide without obtaining a Tourist Guide licence.

Responsibilities

As a Tourist Guide, you are responsible for (i) accompanying tourists (either a group or an individual) using the available transportation; (ii) providing assistance on and explaining about travel plans, tourism objects, travel documents, accommodation, transportation and other facilities; (iii) providing any assistance regarding tourists' baggage and other needs; and (iv) providing assistance to sick tourists, or tourists who experience accidents or losses.

In addition, Bali Regulation No. 5 requires a Tourist Guide to wear Balinese traditional clothing, unless the Tourist Guide is assisting tourists doing trekking, camping, or water sport activities.
